Divorce

Child Custody

Colorado State does not recognize the term child custody; instead, custody is called “Decision Making Responsibility.”  The court may appoint a Child and Family Investigator (CFI) to help determine who should have custody/responsibility of the children and will consider many factors when determining parental rights, including:

  • The role each parent has played in the past
  • The parents ability to foster a loving relationship with the other parent
  • The best interests of the children

Child Support

In Colorado, both parents, regardless of income, must pay a reasonable amount of child support.  The court determines the amount of child support based on factors such as:

  • The number of children who are the subject of the investigation
  • The gross monthly incomes of each parent
  • The monthly cost of day care
  • The monthly cost of family group health insurance

Failure to pay child support can result in the loss of your driver’s license and/or your professional license and will make you a delinquent of the state, negating your right to claim the child on tax returns.  Our attorneys will make sure your financial situation is properly presented to the courts while the amount of child support owed by each parent is determined.
